Retreat Terms & Conditions

 

 

 

Please carefully read all the terms and conditions of this contract detailed below before participating in the Ayurveda and Yoga weekend retreat with Sathyavathi S, the organizer of the retreat (hereinafter, “the Organizer”). For and in consideration for being permitted to participate in the Ayurveda and Yoga retreat (the “Retreat”), you (the undersigned) agree to accept and be bound by the terms and conditions set forth herein.

 

1. PROPERTY POLICIES

1.1. Property Policies

 

Hill Farm comprises woodland, paddocks and a stream. You are

free to walk around but do close gates and keep dogs on a lead

around the sheep. We have a public footpath separating the farm

which leads you to a woodland area, and to the left of that

another field and woodland.

 

Parking: Please ensure vehicles are parked in the designated car park to the right of the track.

Woodlands and Terrain: The ground is very uneven and steps can be dangerous especially when wet. Please take care. Bring advise guests of suitable walking shoes and flip flops for use in the shower. Walking in the woods is at your own risk. Please be aware of falling branches and uneven ground.

 

Damages and Breakages: Any damage or breach of this agreement will be attributable to the person named in this contract, and you agree to indemnify Forest Retreats Ltd and Ma Sucah Ayushkendra against any such breach or damage. You are responsible for keeping drains, waste pipes, showers, sinks and lavatories free from blockages and shall take care not to dispose of any insoluble or damaging substances such as oil or grease via the drains or waste pipes. All areas will be checked after your stay. Please let us know if anything isn’t working or is broken. If necessary, a charge will be made for any replacement items or where extra cleaning or repair is required over and above normal wear and tear. Additional charges will be made where there is significant damage to the land or other farm buildings, vehicles or machinery.

 

Noise/Disturbance: One of the beautiful things about the farm is its quiet rural location. However, because of the farm’s location in the landscape, noise travels up the hills to our neighbours and across the valley. There are also residents on site in close proximity to the hired spaces. We do enforce our noise protocol and reserve the right to ask people to leave if they are causing a disturbance.

• No excessive noise (e.g. amplified music, drumming) after 10pm.

• Fire Pit Gatherings – loud revelling can cause disturbance to other people on site/around the farm. Please keep this in mind when sitting outside around the fire, the hot tub etc.

• Failure to keep noise levels down will result in being asked to leave without recompense.

 

Fire Health and Safety: You are responsible for implementing fire, and health and safety procedures and ensuring your guests/event participants/students and visitors are informed of all safety procedures and the restrictions contained in these Terms and Conditions. Fire Safety information is provided on your arrival, it is your responsibility to make sure you have read it and followed the necessary procedures. The owners Hayley and Tom Court are responsible for starting the Eco-Spa and instructions will be given to maintain. It is your responsibility that guests comply with health and safety instructions, and you must follow all health and safety instructions provided. Care must be taken to monitor the fire and the water temperature at all times.

 

Working Smallholding and Health & Safety: Hill Farm is a working smallholding. Please be aware there are potential hazards around the farm such as the pond, vehicles and farm machinery. However, we are very happy to show you how to have a safe and happy time during your stay here. If you are staying on the farm over a weekend every effort will be made to reduce any disruption caused. The following points help keep the farm working safely for all:

• Please be mindful of farm vehicles moving around.

• There are specific areas of the farm that are out of bounds for safety and privacy reasons. Details of these areas, that include farm buildings and private residential areas will be identified on arrival. Please ensure you and your guests are aware of these areas. • Do not go near any of the farm machinery.

• As above please do not feed or disturb any farm animals. If you have concerns about farm animals please let us know.

• All animals naturally carry micro-organisms, some of which if transmitted to humans can cause ill health which in some cases may be severe or life threatening. Please be mindful of this when on the farm and make sure to wash your hands well with warm water and soap after any contact with animals or their living area, and before eating, drinking or smoking. Please do not wear outside shoes in the venue.

• Do not enter any of the farm buildings unless requested to, or given permission to do so, by a member of staff.

• Please leave gates as you find them – open or closed.

• Please do not connect external electrical items (e.g. vans, lights) to power supplies around the farm buildings.

 

Fires and Barbeques: Fire and barbeques are permitted in designated areas and you must only use wood purchased or given from the farm. Fireworks & Flying Lanterns Fireworks and flying (Chinese/sky) lanterns are not permitted on the farm.

 

1.2. Arrival and departure

 

Check-in: After 4 pm.

Check-out: By 12 pm emptying the yurts or the room. You can continue to stay on the premises until 4 pm on the last day of the retreat.

Please follow the check-out procedure provided by the property to avoid any additional fees. All rooms and accommodation should be left in a clean and tidy condition, recycling and rubbish placed in the designated areas and all bedding stripped off the bed and placed in a bag.

 

1.3. Accommodations

All accommodations include bedding, linens, towels & toilet paper. Guests should bring extra blankets, your own water bottle to fill up the bottle with spring water and toiletries.

2. RETREAT DETAILS.

 

Retreat details such as information about the destination, accommodations, departure and return dates, included meals, included classes and workshops (“Retreat Classes”), and payment details can be found on the Organizer’s event page (https://www.msaholistic.life/events/ayurveda-weekend-retreat-2) (the “Website”).

PLEASE READ AND ENSURE YOU UNDERSTAND THE RETREAT DETAILS AND POLICIES DETAILED HEREIN PRIOR TO SUBMITTING PAYMENT.

 

3. REGISTRATION

 

To reserve a place for the Retreat, you must fill out the Pre-Retreat Assessment and Agreement form provided by the Organizer and submit full payment (collectively, the “Registration Materials”). The total amount for the Retreat specified on the Website (the “Total Payment”) must be paid to reserve your place. You will NOT have a reserved spot for the Retreat if you fail to provide all the Registration Materials.

 

4. CONFIRMATION AND ITINERARY SUBJECT TO MODIFICATION.

 

After the Organizer receives your Registration Materials, you will receive a confirmation email. Please contact ayurveda@msaholistic.life if you do not receive a confirmation email within five (5) business days of submitting your Registration Materials. Thereafter, we may send you, and you consent to receive, correspondence related to the Retreat and the Organizer, including the itinerary for the Retreat. Such itinerary is subject to change and the Organizer expressly reserves the right to modify the itinerary at any time due to the availability of third-party vendors, weather conditions, local conditions, or other circumstances out of our control.

 

5. PAYMENT TERMS.

 

The Total Payment is due as part of the Registration Materials. You may request to have your payment applied to another participant’s registration for the same Retreat if you can no longer attend.

 

6. PASSPORT, VISA AND RELATED ITEMS.

 

You are responsible for obtaining and maintaining a valid passport and all appropriate visas, permits, certificates, and/or other required documentation (“Documentation”) for the country, jurisdictions, areas, etc. you will visit during the Retreat. the Organizer is not responsible if you are denied entry or exit to/from any country or location due to a lack of valid Documentation.

 

7. TRAVEL INSURANCE.

 

You are solely responsible for the cost of any travel insurance and ensuring that you are adequately insured for the full duration of the Retreat with respect to possible illness, injury, death, property damage, loss of baggage and personal items, cancellation and/or curtailment, and/or any other potential losses, damages, costs, expenses, or liabilities (collectively “Losses”). You will be solely responsible for any Losses related to your failure to procure travel insurance. the Organizer is not responsible for any Losses you incur and/or sustain.

 

8. CHANGES OR CANCELLATION.

8.1. Changes.

 

The Organizer reserves the right to make changes to any and all aspects of the Retreat (which may include without limitation changes to the types and/or timing of activities available during the Retreat, items and/or services included with the Retreat, the itinerary, and/or the nature of the Retreat Classes) if, in the Organizer’s sole discretion, the Organizer deems it necessary to do so due to conditions that may be hazardous, dangerous, or otherwise adverse or threatening, if an act or omission of a third-party prevents any such aspects of the Retreat or any portion of the Retreat, or for any other reason considered commercially necessary by the Organizer. You will not be eligible for any refunds of any amounts based on any such changes to the Retreat.

 

8.2. Cancellations.

 

By the Organizer. The Organizer reserves the right to cancel your reservation if your Total Payment is not received and you will not be eligible for any refunds of any amounts.

 

The Organizer further reserves the right to cancel the Retreat prior to the Departure Date in the event an insufficient number of registrants are confirmed for the Retreat or for any other commercial reason in the Organizer’s sole discretion and, in such an event, you will receive a full refund of the amount you remitted to the Organizer, but in no event will the Organizer be responsible for any other amount, including preparation costs, airfare, travel documents, or any other Losses or claimed damages.

 

By You. All cancellations by you must be in writing and emailed to the Organizer at the contact email address specified on the Website. Total payment will be refunded up to 30 days prior to the event. Half (50%) of the Total Payment will be refunded up to 20 days prior to the event. If cancellation takes place within 14 days of the Retreat date, you forfeit the entire amount remitted to the Organizer. The Organizer will advertise the space and endeavour to find a replacement, in which case you will be refunded the full amount.

 

You may request to have your payment applied to another participant’s registration for the same Retreat if you can no longer attend.

 

8.4. Effect of Changes or Cancellation.

 

In the event of any change or cancellation, you acknowledge that you will have no right of refund of the Total Payment (whether in whole or in part, except as expressly provided in Sections above) and no right to claim compensation for any Liabilities incurred and/or sustained by virtue of any change or cancellation.

 

9. COVID-19

 

9.1. Cancellations due to Covid-19 restrictions.

 

If we are unable to go ahead due to Covid-19 restrictions; you will receive a full refund.

 

9.2. Cancellations due to contracting Covid-19.

 

If you have contracted Covid-19, the normal cancellation policy per Section 8 will apply.

 

10. PHOTOS, VIDEO, OTHER MEDIA RELEASE.

 

By and in consideration for being permitted to participate in the Retreat, you irrevocably grant the Organizer and its agents and representatives all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, “Likeness”) worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes. You agree that your Likeness may be used, reproduced, displayed, exhibited, published, edited, or distributed by the Organizer at its sole discretion. You understand that your Likeness may be used in various publications, promotional or marketing materials, and/or social media, unrestricted by time or geographic area and consent to such uses. You further understand and grant permission to the Organizer and its agents and representatives to electronically display any Likeness of you on the Internet or in other public settings. You hereby waive the right to inspect or approve all materials in which your Likeness may appear. You further waive any right to royalties or other compensation arising or related to the use of your Likeness. This release applies to all photographic, audio, and/or video recordings collected as part of, about, and/or during the Retreat (by the Organizer or any third-party). There is no time limit on the validity of this release nor is there any geographic limitation on where materials including your Likeness may be used, reproduced, displayed, exhibited, published, and/or distributed by or on behalf of the Organizer.

 

11. VOLUNTARY PARTICIPATION IN POSSIBLY STRENUOUS ACTIVITY.

 

You acknowledge that you are voluntarily participating in the Retreat with the Organizer, which may include strenuous physical activity including without limitation walking, hiking, dancing, swimming, jumping, Yoga, Bodywork, Retreat Classes, and various other exercises or physical activity (“Physical Activity”). Although care will be taken to make the activities suitable to your capacities. You will ensure that you make the Organizer aware of any limitations you have before the onset of the retreat. You acknowledge that you are fully aware of the risks and hazards connected with participation in the Retreat and/or engaging in Physical Activity, which may include the risk of serious injury (e.g., muscle strains, pulls, tears, broken bones, shin splints, heart attacks and other illnesses) or death, and you hereby elect to voluntarily participate in such Physical Activities as part of the Retreat.

 

12. HEALTH AND FITNESS ELIGIBILITY.

 

You represent that you are over the age of eighteen (18) and are healthy, in good physical and mental health, and are at a level appropriate to participate in, and are fully capable of participating in, the Retreat. You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in the Retreat, including any Physical Activities. You have consulted with your physician and your physician has authorized you to participate in the Retreat, including any Physical Activities. You will discuss and address any questions or concerns you may have about your physical or mental health with the appropriate healthcare professional prior to the Departure Date. Documentation from your physician confirming your clearance to participate in the Retreat can be provided upon request. If at any time, you have any doubts about your physical condition or fitness to participate in any aspect of the Retreat, you will cease participation in the same and seek appropriate medical attention. YOU ARE HEREBY ADVISED THAT ANY MEDICAL OR EVACUATION EXPENSES WILL BE YOUR SOLE RESPONSIBILITY. As a result, we strongly encourage you to purchase any travel insurance with appropriate coverage for your needs. We reserve the right in our sole discretion to refuse your participation in the Retreat, any Retreat Classes, Physical Activities, and/or any other activities, due to medical, fitness, or other grounds. The Organizer also reserves the right to deny participation in the Retreat or any related activities at any time to individuals demonstrating behaviour that may result in injury to themselves or others.

 

13. ASSUMPTION OF RISK.

 

You understand that serious accidents may occur during Physical Activities, including without limitation Yoga and Retreat Classes, and that participants can sustain fatal and/or serious personal injury. It is your own responsibility to familiarize yourself with all possible relevant travel information in connection with your participation in the Retreat. Understanding and in full consideration of the foregoing, you agree to solely and exclusively assume full and complete responsibility for and the risks inherent in travel and engaging in Physical Activity (including yoga and Retreat Classes) which may include injury, death, property damage, and/or any other kind of Liability, whether foreseen or unforeseen, which may occur during your participation in the Retreat. YOU ACKNOWLEDGE THAT YOUR DECISION TO PARTICIPATE IN THE RETREAT IS MADE IN FULL CONSIDERATION OF THE FOREGOING INFORMATION AND THAT YOU SOLELY AND EXCLUSIVELY ASSUME THE RISKS INVOLVED WITH PARTICIPATING IN THE RETREAT. IN NO EVENT WILL THE ORGANIZER BE LIABLE FOR ANY LIABILITIES ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THE RETREAT.

 

14. INJURY.

 

In the event you are injured while participating in the Retreat, you agree to assume all financial obligations for all medical costs you incur. You acknowledge and agree that IN NO EVENT SHALL THE ORGANIZER AND/OR ANY OF THE ORGANIZER PARTY BE LIABLE OR RESPONSIBLE FOR ANY LOSSES OR LIABILITIES ARISING OUT OF YOUR PARTICIPATION IN THE RETREAT.

 

15. WAIVER OF LIABILITY AND RELEASE.

 

IN CONSIDERATION FOR PARTICIPATING IN THE RETREAT, YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE THE ORGANIZER, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, VOLUNTEERS, GUIDES, AND OTHER REPRESENTATIVES (EACH “THE ORGANIZER PARTY” AND COLLECTIVELY, THE “THE ORGANIZER PARTIES”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (INCLUDING BUT NOT LIMITED TO ANY EXEMPLARY, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES, MEDICAL EXPENSES, LOST WAGES/INCOME, LOSS OF SERVICES, LOST PROFITS, PROPERTY DAMAGE, PAIN, ILLNESS, AND DEATH) (COLLECTIVELY “LIABILITIES”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE RETREAT AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY THE ORGANIZER PARTY OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY THE ORGANIZER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. You have been advised and urged to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the Retreat. You acknowledge that whether or not you elect to purchase or not purchase travel insurance, you will not look to any of the Organizer Parties for reimbursement for any Liabilities suffered or occurring during your travel and/or participation in the Retreat.

 

16. INDEMNITY.

 

YOU FURTHER HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS THE ORGANIZER PARTIES FROM ANY AND ALL LIABILITIES (INCLUDING WITHOUT LIMITATION COURT COSTS AND ATTORNEYS’ FEES) THAT ONE OR MORE OF THE ORGANIZER PARTIES MAY INCUR AS A RESULT OF YOUR PARTICIPATION IN THE RETREAT, WHETHER CAUSED BY THE NEGLIGENCE OF ANY THE ORGANIZER PARTY OR OTHERWISE (BUT EXCLUDING ANY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF A THE ORGANIZER PARTY), TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.

 

17. BINDING EFFECT.

 

By selecting the check box “I have read and agree to the terms and conditions” on the Attendee Registration form it is your express intent that this Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE any of the Organizer Parties.

 

18. GENERAL.

18.1. Entire Agreement.

 

This Agreement constitutes the entire agreement between you and the Organizer, and supersedes any prior agreement, regarding the subject matter herein. You acknowledge and represent that no oral representations, statements, or inducements, apart from those set forth herein, have been made to you by any of the Organizer Party.

 

18.2. Force Majeure.

 

If the Organizer is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of any Act of God, strike, trade dispute, fire, inclement weather, breakdown, interruption of transportation networks/means, government or political action, acts of war or terrorism, acts or omissions of a third party, or for any other cause whatsoever outside of the Organizer’s reasonable control, THE ORGANIZER WILL BE UNDER NO LIABILITY WHATSOEVER TO YOU AND MAY, AT THE ORGANIZER’S SOLE DISCRETION, BY WRITTEN NOTICE TO YOU, EITHER CANCEL THE RETREAT OR TAKE ANY OTHER REASONABLE ACTION.

 

18.3. Interpretation.

 

You acknowledge and agree that this Agreement, including the releases and waivers of liability herein, are intended to be as broad and inclusive as permitted by applicable law.

 

18.4. Severability.

 

If any portion(s) of this document is/are held by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, such portion(s) shall be interpreted and/or reformed without further action of the parties hereto to render them valid and enforceable when applied to the facts at issue and the lawfulness, validity, and enforceability of such provision(s) as applied to any other facts, and the lawfulness, validity, or enforceability of the remaining provisions of this Agreement shall in no way be affected or impaired thereby.

 

18.5. Waiver.

 

The failure or delay by the Organizer to enforce or exercise any provisions of this Agreement shall not constitute or be deemed a waiver of such provision or any other provisions herein. Furthermore, any waiver or breach of any provision of this Agreement shall not amount to a waiver of any other provision.

 

18.6. Headings.

 

The headings in this Agreement are for convenience only and in no way define, limit, or describe the scope or intent of any provisions herein.

Cancellations And Refund Policy 

Cancellations and Refund Policy for Retreat Bookings:

 

By the Organizer. The Organizer reserves the right to cancel your reservation if your Total Payment is not received and you will not be eligible for any refunds of any amounts.

 

The Organizer further reserves the right to cancel the Retreat prior to the Departure Date in the event an insufficient number of registrants are confirmed for the Retreat or for any other commercial reason in the Organizer’s sole discretion and, in such an event, you will receive a full refund of the amount you remitted to the Organizer, but in no event will the Organizer be responsible for any other amount, including preparation costs, airfare, travel documents, or any other Losses or claimed damages.

 

By You. All cancellations by you must be in writing and emailed to the Organizer at the contact email address specified on the Website. Total payment will be refunded up to 45 days prior to the event. Half (50%) of the Total Payment will be refunded up to 20 days prior to the event. If cancellation takes place within 14 days of the Retreat date, you forfeit the entire amount remitted to the Organizer.

The Organizer will advertise the space and endeavour to find a replacement, in which case you will be refunded the full amount.

 

You may request to have your payment applied to another participant’s registration for the same Retreat if you can no longer attend.

 

Effect of Changes or Cancellation.

 

In the event of any change or cancellation, you acknowledge that you will have no right of refund of the Total Payment (whether in whole or in part, except as expressly provided in Sections above) and no right to claim compensation for any Liabilities incurred and/or sustained by virtue of any change or cancellation.

Refund Policy for Donations or Contributions:

If you have made a donation or contribution to us for the services you have received or to support the practice of Dr (Ayu) Sathyavathi S and wish to seek a refund for any reason, please inform us within 7 days of making the donation to receive a refund. This process can take a few days but you will receive a confirmation of the initiation of a refund soon after it is initiated.
